FSB argues that asset finance lenders can perhaps better serve prospectively-good SME borrowers if they deploy personal guarantees (PGs) more selectively.
FSB issued a super-complaint to the Financial Conduct Authority (FCA) resulting in the FCA’s agreement to collect data to evidence harm but only for sole traders and other SMEs that were within the FCA’s consumer perimeter. FSB have argued that this fails to focus on where most potential harm is taking place.

CMCs see their role as champions of consumers, having increased the value of compensation and successful complaints by more than 10%.
The FCA were given some oversight over CMCs in 2016. Evans argues that the outcome from FCA oversight has been poor and has not served customers’ best interests. Following this, the CMC sector has reduced to 10% of its former size.
Evans argues that there are gaps in the consumer redress process which can be better addressed by effective CMCs following best practice and working alongside lawyers.
