ASSET FINANCE CASE STUDY - SMEs, FSB and PGs: how lenders can better serve SMEs

Martin McTague, national chair of the Federation of Small Businesses (FSB)

FSB argues that asset finance lenders can perhaps better serve prospectively-good SME borrowers if they deploy personal guarantees (PGs) more selectively.

FSB issued a super-complaint to the Financial Conduct Authority (FCA) resulting in the FCA’s agreement to collect data to evidence harm but only for sole traders and other SMEs that were within the FCA’s consumer perimeter. FSB have argued that this fails to focus on where most potential harm is taking place.

  • Listen to the FSB perspective
  • Consider how lenders and FSB can interact to achieve better outcomes for both customers and lenders

AUTO FINANCE CASE STUDY - Learning about good consumer outcomes from a claims management company’s perspective (CMCs)

Simon Evans, managing director of Consumer Redress Association (CRA)

CMCs see their role as champions of consumers, having increased the value of compensation and successful complaints by more than 10%.

The FCA were given some oversight over CMCs in 2016. Evans argues that the outcome from FCA oversight has been poor and has not served customers’ best interests. Following this, the CMC sector has reduced to 10% of its former size.

Evans argues that there are gaps in the consumer redress process which can be better addressed by effective CMCs following best practice and working alongside lawyers.

  • Listen to the CRA perspective
  • Consider how to work with regulator, ombudsman and others to achieve better outcomes from disputes

INDUSTRY ANALYSIS - Learning the regulatory quick-step: the implications of a transition from law to regulation

Wayne Gibbard, partner, Shoosmiths

How should the industry respond to a regulator which seems beset by unintended consequences from their interventions which often fail to achieve the intended results? Are we doing our bit to help make regulation work?

The FCA is facing significant challenges in intervening successfully in what are often complex financial services markets; significant resource constraints; problems associated with their scope (perimeter); political pressure to be seen to act promptly and effectively; how to balance regulation, innovation and maintain healthy market competition; and managing the apparent differing objectives of FOS, FCA and the courts.

  • What are the opportunities and challenges with an increasingly regulation-led industry?
  • How can the industry engage more effectively with the FCA and other participants in the regulatory ecosystem?
  • How does the Government view regulators and manage oversight?
